Terms of Use

These Terms of Use (“Terms”) govern access to Pendable Sites, the hosted multi-tenant website platform operated by Pendable LLC (“Company”, “we”, “us”). The site at billing.sites.pendable.io and related Pendable Sites hostnames together are the “Service”. By using the Service you accept these Terms on behalf of yourself or the entity you represent. You must be at least 18 years old.

The Service

We provide hosted sites, dashboards, and related software for tenants. We may modify, suspend, or discontinue parts of the Service. We do not promise uninterrupted or error-free operation.

Accounts

You are responsible for account credentials and for activity under your tenant. Notify us of unauthorized use. We may suspend or terminate access for breach of these Terms or misuse of the Service.

Acceptable use

You may not use the Service to violate law, infringe others’ rights, distribute malware, send unsolicited bulk messages, or attempt to gain unauthorized access to our systems or other tenants’ data. Tenant content remains your responsibility.

Fees and Paddle

Paid tenants are billed monthly in USD as configured for that site. Payment is processed by Paddle (paddle.com), which is merchant of record for checkout, tax, and invoices. Refunds are described in our Refund Policy.

Intellectual property

We and our licensors retain the Service software and branding. You retain rights in content you upload, and grant us a license to host and display it as needed to operate the Service.

Disclaimers and liability

THE SERVICE IS PROVIDED “AS IS”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENDABLE LLC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, OR FIFTY US DOLLARS, WHICHEVER IS GREATER.
